A Long Island woman has been cleared of drunken driving accusations after testifying she was fleeing a man who was about to attack her.
Nassau County Judge George Peck found Donna Powell not guilty of all charges except for a minor traffic violation Friday in a non-jury trial.
The Northport woman, who’s 48, admitted driving with more than twice the legal limit of alcohol in her system last October. She said a man she met earlier in a bar tried to grab and grope her after pullng his car over in a wooded lot. She fled when he got out to relieve himself.
New York law says a person is justified in committing a crime if doing so avoids a greater harm.
