		<description><![CDATA[Demand NYS Attorney General Special Investigation of the $4.1 million Levy/Spota Bribe

     Why won&#039;t Suffolk DA Tom Spota disclose EVERYTHING the DA&#039;s office knows about Steve Levy? How long are they going to try to keep up the charade of Levy&#039;s &quot;campaign fundraising irregularities&quot;? When are they going to disclose ALL of Levy&#039;s bad acts, criminal acts and active concealment of illegal acts?

     Join me in demanding a full investigation of the $4.1 million dollar bribe deal between Tom Spota and Steve Levy.
     
     I filed the following formal complaint both by registered, return receipt requested mail to the NYS Attorney General’s Public Integrity Bureau, and by registered, return receipt requested mail to Gov Cuomo. Please take 15 minutes and do the same.

     As a 52 year old life-long resident of Suffolk County, NY, I am disgusted and outraged at the blatant corruption, patronage, cronyism and bribery that flourishes in many branches of our county government.
     Suffolk County has a long history of abuse and misuse of the Grand Jury process and is infamous for its 30 year history of selective and malicious prosecution by our District Attorney’s office.
     This latest fiasco, in which our current County Executive, Steve Levy, paid a $4 million “slush-fund” bribe to SC DA Tom Spota’s office in exchange for not being charged and being permitted to serve out his term, is simply more than I can bear witness to and remain silent.
     I therefore demand that you forward my complaint to the NYS Attorney General’s office immediately for a full investigation:
     Why an Executive Order of Superseder From Governor Cuomo re: District Attorney Thomas Spota is Needed.                  
     County Executive Steve Levy and District Attorney Thomas Spota have an illegal agreement, one that is predicated on no legal authority.   In return for turning over $4 million from his political campaign account, District Attorney Thomas Spota will permit Steve Levy to serve out the remainder of his term as Suffolk’s County Executive.   Neither has any right to give or receive millions of dollars, one to another.   Election Law Article 14 provides no authorization.   Section 14-130 specifically forbids it.   Our chief executive and law enforcement officers are not obeying the laws.   They’ve made up their own.   The New York Times and the New York Post’s Michael Goodwin have forcefully condemned what is transpiring.                
     If Spota has evidence of crimes committed by Levy his duty is to prosecute him.   If he does not he has no license to accept $4 million from Levy, none.   He has no authority to remove or allow Levy to remain in office.   If a quid pro quo agreement exists whereby,   in return for Levy abjuring reelection and handing Spota $4 million Levy will not be criminally charged by Spota but will be allowed – by Spota - to complete his term of office, it is a criminal agreement .   Bribery, Bribe Receiving, Conspiracy and other Penal Laws proscribe it. Election Law Section 17-158 declares it a felony.                 
     The present state of affairs in Suffolk County is untenable.   Each and every one of you, every day, will come more and more to the undersigned’s position.                  
     Article IV, Section 3 of the State Constitution charges the Governor to “take care that the laws are faithfully executed.”   Pursuant to it Executive Law Section 63(2) empowers the Governor to require his Attorney General to investigate unlawful acts of persons and suspend and supersede a district attorney’s jurisdiction and authority over all matters specified in his executive order of superseder.   He is empowered to designate an extraordinary term of the Supreme Court authorized to empanel an extraordinary grand jury before which the Attorney General may seek indictments.   All proceedings are exclusively within the extraordinary term’s jurisdiction.   Prosecutors are Assistant Attorneys General. The justice designated as the extraordinary term will come from another region of the state.   
     Please contact me by phone, letter or email (provided below) when you have received this complaint and keep me apprised of actions you direct the NYS Attorney General’s office take to investigate.
